Acceptance of Terms

By accessing or using the website www.kgwebinfotech.com or engaging KG Web Infotech for any service, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and clients.

Services Provided

KG Web Infotech provides IT and digital marketing services including but not limited to:

Website design and development
Mobile application development
Custom software / CRM / ERP solutions
IT infrastructure setup
Digital marketing (SEO, social media, ads)
WhatsApp / SMS / Email marketing software

The scope, timeline, and deliverables for each project are defined in a separate Work Order or Service Agreement signed with the client.

Client Obligations

Clients agree to:

Provide accurate and complete information required for project execution.
Respond to queries, feedback, and approvals within reasonable time to avoid project delays.
Not use our services for any illegal, unethical, or harmful purpose.
Ensure that any content, images, or material provided does not infringe third-party intellectual property rights.

Payment Terms

Unless stated otherwise in a separate agreement:

All project fees are payable as per the milestone schedule defined in the Work Order.
Advance payment (typically 30–50%) is required before project commencement.
Final deliverables will be released only after full payment is received.
Invoices are payable within 7 days of date of issue.
Late payments may attract interest at 1.5% per month after the due date.
All prices are exclusive of GST (18%) unless otherwise stated.

Intellectual Property

Upon full payment, the client receives ownership rights to the final deliverables (e.g., website, app) as defined in the project agreement. However:

KG Web Infotech retains the right to showcase the work in its portfolio unless expressly restricted in writing by the client.
Any proprietary tools, frameworks, or internal code libraries developed by KG Web Infotech remain our intellectual property.
Third-party assets (fonts, plugins, stock images, APIs) are subject to their respective licenses.

Confidentiality

Both parties agree to maintain confidentiality of any sensitive information shared during the engagement. KG Web Infotech will not disclose client business data, source code, or proprietary information to any third party without written consent, except as required by law.

Limitation of Liability

KG Web Infotech's total liability for any claim arising out of or related to our services shall not exceed the total fees paid by the client for the specific service in question. We are not liable for:

Indirect, incidental, or consequential damages.
Loss of data, revenue, or business opportunities beyond our reasonable control.
Downtime, failures, or issues caused by third-party hosting, APIs, or platforms.

Termination

Either party may terminate a service agreement with 15 days' written notice. In case of termination:

Fees for work completed up to the termination date remain payable by the client.
KG Web Infotech will deliver all completed work upon receipt of outstanding payments.
We reserve the right to immediately terminate services in case of abusive behaviour, non-payment, or illegal use.

Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Delhi NCR, India.
